JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-09-2019 Petitioners seek bail in anticipation of their arrest in connection with Balrampur P.S. Case No. 53 of 2019 registered for the offences punishable under Sections 341, 323, 326, 307, 379, 427, 504 and 506/34 of the Indian Penal Code. Allegation against the accused persons, including the petitioners is of assaulting the informant and others indiscriminately and causing injuries to them. Submission of learned counsel for the petitioners is that there is case and counter case between the parties and earlier proceedings under Sections 144 and 145 Cr.P.C. were initiated at the instance of father of petitioners, which has been decided in his favour and due to that the present case has been

Heard learned APP and learned counsel for the informant. They have opposed the prayer for anticipatory bail of the petitioners.

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VI, Katihar, in connection with Balrampur P.S. Case No. 53 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
