JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 19-05-2016 Heard learned counsel for the petitioners and the learned Additional Public Prosecutor, appearing on behalf of the State. This application for grant of anticipatory bail arises out of Khodawandpur P.S.Case No. 137/2015, disclosing offences under sections 147, 148, 149, 341, 323, 307, 379, 427, 504 of the Indian Penal Code.
Allegation in the First Information Report is that the accused persons assaulted the husband of the informant and brother of the husband of the informant, when they were engaged in repair work of their house.
Learned counsel for the petitioner has submitted that so far these petitioners are concerned, there is no specific allegation of assault against them. It has further been submitted that lodging
Patna High Court Cr.Misc. No.19381 of 2016 (2) dt.19-05-2016 of the present F.I.R. is a counter blast to the earlier case, being Khodawandpur P.S.Case No. 130/2015, lodged by the brother of the informant on 20.6.2015. It has been stated in paragraph 3 of the application that the petitioners have no criminal antecedent. Considering the above, this application is allowed. Let the petitioners, abovenamed, in the event of their arrest/ surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the S.D.J.M., Manjhaul, Begusarai in Khodawandpur P.S.Case No. 137/2015, subject to the conditions as laid down under section 438(2) of the Cr.P.C. This is subject to the condition that the petitioners shall present themselves before the police/ court, as the case may be, as and when required and in the event of failure on their part to appear before the court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
