Mr. Nivedita Nirvikar ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 12-10-2018 Heard Mr. Shashi Bhushan Kumar Manglam, learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State.
The present writ application has been filed by the petitioner for a direction to the respondents to nominate the petitioner as Member in the Managing Committee of Rajendra High School, Pahlejpur.
Learned counsel submits that petitioner's representation is pending before the Regional Deputy Director of Education, Saran Chapra since 2011.
He refers to Annexure-5 to the writ application. From perusal of the Annexure-5, it appears that petitioner has represented the Regional Deputy Director of Education, Saran at
Patna High Court CWJC No.14460 of 2013(5) dt.12-10-2018 2/2 Chapra enclosing the document in support of his claim as donor but till date no decision was taken by the Regional Deputy Director, Saran at Chapra.
Without going into the validity of the claim of the petitioner, the writ petition is disposed of with liberty to the petitioner to file fresh representation addressed to the Regional Deputy Director, Saran at Chapra for nomination as donor member and if such representation is filed by the petitioner alongwith a copy of this order, the Regional Deputy Director of Education will pass appropriate order in accordance with law with regard to claim of the petitioner for nomination as donor in the school in question.
Necessary decision in this regard may be taken by the respondent Regional Deputy Director, Saran at Chapra within a maximum period of four months from the date of filing of such representation.
With the aforesaid, the writ petition stands disposed of.
