2. The petitioner seeks regular bail in connection with Majhauliya P.S. Case No. 538 of 2024 registered for the offence under Sections 80, 123 and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. The petitioner, who is the husband of the deceased, is said to have participated in the killing of the deceased. From the perusal of the FIR, it appears that the deceased had consumed poison.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 05.06.2025.

5. Learned A.P.P. for the State has vehemently

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran/concerned Court below in connection with Majhauliya P.S. Case No. 538 of 2024 subject to condition that:- (i). The Petitioner will cooperate in the framing of charge and he will appear personally on each and every date in the Court below till the framing of charge. After the framing of charge, he can appear personally or through his lawyer on the date fixed by the Court below.
