JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but it appears that in course of investigation, the name of the petitioner surfaced in this case. Moreover, after due investigation, police submitted final form showing the accusation untrue against the petitioner.

Learned counsel for the petitioner submits that the concerned court differed with the finding of the police and took cognizance of the offence against the petitioner also but as a matter of fact neither any notice nor any summon was ever served upon the petitioner and without getting any service, petitioner was declared absconder by the court below. It is further contended by

Patna High Court Cr.Misc. No.58000 of 2015 (2) dt.04-01-2016 2/2 him that co-accused Shubhash Roy in whose house the dead body was recovered as well as other accused have already been granted privilege of bail whereas petitioner is in jail custody since 31.9.2015.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, namely, Ranjeet Roy be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II, Munger in connection with Sessions Trial No.308/A/10 arising out of Dharahara P.S. Case No.85 of 2009.
