2. In the present case, the petitioner seeks bail in connection with Sikarpur P.S. Case No. 785 of 2024, registered for the offences under Sections 121, 121(1), 126(2), 115(2), 118(1), 109, 352 and 303(2) of the B.N.S and Section 3⁄4 of the Prohibition of Witch Practices Act.
3. As per the prosecution case, petitioner and 16 other co-accused persons, who were variously armed, came to the land of the informant and tried to forcibly capture it. When the informant opposed, he and his family members were assaulted by the petitioner and other co-accused persons.
4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been
Patna High Court CR. MISC. No.61139 of 2025(2) dt.09-09-2025 2/3 falsely implicated in this case. No occurrence as alleged has ever taken place. Land dispute is admitted and the present dispute arose over drainage of dirty water from the toilet on the land of the informant. The present case is counter blast of Sikarpur P.S. Case No. 775 of 2024 lodged by the petitioner's side against the informant side. There is inordinate delay of 5 days in lodging the FIR and there is no explanation for the same. Other co-accused persons have been granted anticipatory bail by a Co-ordinate Bench of this Court vide order dated 18.07.2025 passed in Cr. Misc. No. 44697 of 2025. The petitioner is in custody since 15.06.2025 and charge sheet has been submitted. Petitioner is having clean antecedent.
5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner.
6. Having regard to the fact and circumstances and submission made on behalf of the parties and considering the general and non-specific nature of allegation against the petitioner and also considering the period of custody of the petitioner along with his clean antecedent and submission of charge sheet, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the
Patna High Court CR. MISC. No.61139 of 2025(2) dt.09-09-2025 3/3 satisfaction of learned ACJM-VI, Bettiah, West Champaran/concerned court, in connection with Shikarpur P.S. Case No. 785 of 2024, subject to the condition laid down under Section 437(3) of the code of Criminal Procedure and other following conditions:
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
