This is an application for grant of anticipatory bail in connection with Halsi P.S. Case No. 167 of 2015 registered for the offence punishable under Sections 366(A), 365, 120(B)/34 of the Indian Penal Code and 4/6 of POSCO Act.
The allegation is regarding one Kisan Kumar abducting the victim girl and establishing physical relation with her. The name of the petitioners have transpired during the course of investigation as the persons who are said to have aided the said Kishan Kumar in abducting the victim girl.
The learned counsel for the petitioners submits that the petitioners herein are not the FIR named accused persons, no role
Patna High Court Cr.Misc. No.61820 of 2017 (3) dt.29-01-2018 2/2 has been assigned by the victim girl in her statement made under Section 164 Cr.P.C. as far as the petitioners herein are concerned, either regarding her abduction by them or regarding doing any untoward incident towards her. It is further submitted that the petitioners have clean antecedent.
Having regard to the facts and circumstances of the case, I deem it fit and proper to admit the petitioners herein to the privilege of anticipatory bail, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Lakhisarai in connection with Halsi P.S. Case No. 167 of 2015 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
