The petitioner seeks bail in connection with Basnahi P.S. Case No. 56 of 2019 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. In instant case, total 55 liters of illicit liquor was seized. The petitioner is in custody since 05.06.2019.

Considering the fact that the petitioner has no criminal antecedent and having regard to the quantity of liquor seized, the Court is inclined to grant bail to the petitioner

Patna High Court CR. MISC. No.55078 of 2019(2) dt.02-09-2019 2/2 subject to cash deposit of Rs. 25,000/- (twenty five thousand) in the Court below and on deposit of the same, the Court below shall release the petitioner, above named, on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Saharsa in connection with Basanahi P.S. Case No. 56 of 2019.

The cash deposit of Rs. 25,000/- shall abide by the final outcome of the pending criminal case.
