2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 323, 379, 386, 386 and 34 of the Indian Penal Code.
3. The case of the prosecution, in brief, is that seven named and 10 unknown miscreants, including the petitioner assembled and threatened to kill the informant. It is further alleged that they tried to set fire to the Pocklane machine and demanded a ransom of Rs. 5 crores, threatening dire consequences in case of non-fulfillment. It is further alleged that they took Rs. 1,50,000/-in cash from the shop.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in
Patna High Court CR. MISC. No.61861 of 2025(2) dt.08-09-2025 2/2 connection with the present case. It is further submitted that on perusal of the FIR, it is clear that there is no specific overt act attributed to the petitioner. It is also submitted that similar situated co-accused persons have been extended the privilege of bail by a co-ordinate Bench of this Court vide order dated 29.05.2025 passed in Cr. Misc. No. 16613 of 2025 and the case of this petitioner stands on similar footing.
5. Learned APP appearing on behalf of the State has vehemently opposed the prayer for bail stating that the petitioner is having seven criminal antecedent.
6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Atri P.S. Case No. 135 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya.
