2. The petitioners apprehend arrest in a case registered for the offence under Sections 323, 376, 504 of the IPC and Section 4 of the POCSO Act.

3. As per the prosecution case, on 19.01.2023, the minor daughter of the informant had gone for natural call at 7 P.M. where this petitioner along with other co-accused kidnapped the victim and committed rape on her.

4. It is submitted on behalf of petitioner that petitioner has falsely been implicated in this case. Petitioner claims clean antecedent.

5. However, learned A.P.P. for the State opposed the bail petition and submitted that the under Section 164 of the

Patna High Court CR. MISC. No.62757 of 2023(2) dt.16-10-2023 2/2 Cr.P.C., the victim girl has stated that when she went for natural call the petitioner took her in his house and kept her for seven days and committed wrong with her.

6. Considering the accusation and gravity of offence and statement of the victim made under Section 164 of the Cr.P.C., the prayer for anticipatory bail of petitioner is rejected. (Prabhat Kumar Singh, J) Shishir/- U T
