JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section414 of the Indian Penal Code. Two persons were caught with stolen motorcycle and disclosed that the petitioner and some others had given seized motorcycles to them for sale and thereafter, the house of the petitioner was raided and allegedly, two motorcycles were recovered from house of the petitioner.

Submission on behalf of petitioner is that only one motorcycle and, that too, of father of the petitioner was recovered and so far as recovery of second motorcycle is concerned; the same has not been recovered from house of the petitioner.

No.19864 of 2016 (2) dt.06-05-2016 2/2 To fortify the above-said contention, he drew my attention towards Annexure-2 to this petition and submitted that as a matter of fact, one seized motorcycle had been purchased by father of the petitioner from one Vidya Bhushan Srivastava. Moreover, petitioner is in jail custody since 28-01-2016 without having any criminal antecedent.

Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sahebganj P.S. Case No. 21 of 2016 to the satisfaction of learned Sub Divisional Judicial Magistrate (West), Muzaffarpur. (Hemant Kumar Srivastava, J) A.K.V./- U T
