Mr. Parmanand Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 30-06-2020 Heard Mr. Rajesh Kumar, learned counsel for the petitioner and Mr. Parmanand Kumar, learned APP for the State.

The petitioner seeks modification of the order dated 10.04.2018 passed by a Bench of this Court in Cr. Misc. No. 12701 of 2018. By the aforesaid order, the petitioner was granted anticipatory bail but subject to his surrender before the court below within a period of six weeks of the passing of the order.

The petitioner could not surrender on time for the

Patna High Court CR. MISC. No.54281 of 2019(2) dt.30-06-2020 2/2 reason that he was away from the State of Bihar for earning his livelihood.

For the reasons stated in the petition, the prayer is allowed.

The order dated 10.04.2018 is modified to the extent that if the petitioner surrenders before the court below within a period of four weeks from today, he shall be released on bail on the same terms and conditions which were fixed on 10.04.2018.

The order stands modified to the extent indicated above.

The modification petition stands disposed of accordingly.
