1. The petitioner seeks regular bail in connection with Sessions Trial No. 1110 of 2025 (arising out of Malsalami P. S. Case No. 448 of 2023), registered for the offences punishable under Section 302 of the Indian Penal Code and Section 27 of the Arms Act.

2. Heard Mr. Pushkar Narayan Shahi, learned senior counsel appearing for the petitioner and Mr. Prem Kumar Jha, learned APP for the State and perused the FIR as well as the trial court's order.

3. In the facts and circumstances of this case and mainly considering petitioner's the pleas that the FIR has been registered against unknown persons and during the course of

No.59459 of 2025(2) dt.29-08-2025 2/2 investigation, the deceased's uncle raised suspicion against this petitioner as being involved in the killing of the deceased except this and confessional statement of the petitioner there is no material against him, though, the petitioner's earlier prayer was rejected on merits but giving him a liberty to renew the same after framing of charge and now the petitioner's trial has started after framing of charges upon him on 05.06.2025 and thereafter, no prosecution witness has been examined till date as stated in the petition, coupled with the petitioner's custody period, this court is inclined to release him on bail. Accordingly, let the petitioner named-above be enlarged on bail in connection with Sessions Trial No. 1110 of 2025 (arising out of Malsalami P. S. Case No. 448 of 2023), on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
