JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 26-04-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in registered for the offences punishable under section 395 of the Indian Penal Code.

As per the prosecution case, four persons riding on two motorcycle on the point of pistol snatched mobile phone, cash Rs.2500/- and other articles from the informant. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner is not named in the FIR. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner has got clean antecedent as stated in paragraph 3 of the bail petition. Petitioner is in custody since 13.9.2021.

No.70024 of 2021(3) dt.26-04-2022 2/2 Learned counsel for the State opposes the prayer for bail and submits that during investigation looted purse of the informant and the motorcycle used in the crime have been recovered from the possession of the petitioner. Considering the nature of accusation and aforesaid recovery from the possession of the petitioner, his prayer for bail is refused.
