This application, for grant of anticipatory bail, arises out of Alinagar P.S. Case No. 38/2016, disclosing offences under Sections 147, 148, 149, 341, 323, 504, 506 and 307 of the Indian Penal Code.
The occurrence appears to have taken place when the informant was returning after casting the vote in an election. Learned counsel appearing on behalf of the petitioner appears to be right in his submission that no offence under Section 307 of the Indian Penal Code is made out against the petitioner in view of general and omnibus allegation of assault made by lathi, fists and slaps etc.,
Patna High Court Cr.Misc. No.43373 of 2017 (2) dt.03-10-2017 2/2 Considering the above submission, this application is allowed. Let the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Benipur, Darbhanga in connection with Alinagar P.S. Case No. 38/2016, subject to the condition laid down under Section 438(2) of the Cr.P.C.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
