The petitioner is in custody since 08.10.2012 in connection with N.D.P.S. Case No. 120 of 2012 arising out of Pipra P.S. Case No. 218 of 2012 registered for the offences punishable under Sections 20B, 22, 23 and 24 of the Narcotic Drugs and the Psychotropic Substances Act, 1985. It is submitted on behalf of the petitioner that as per the FIR, eight persons were taken into custody in connection with the recovery of a packet of Charas. It is further submitted that as per the FIR, there is no specific statement as to in whose conscious possession the said Charas is said to have been recovered. It is further submitted that more than six persons out of those arrested have already been extended the privilege of bail and the said orders are incorporated in the supplementary affidavit filed by the

Considering the period of custody and also that other similarly situated persons have been extended the privilege of bail, let the petitioner, Swarup Raut @ Ramswarup Patel be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 8th Additional Sessions Judge, East Champaran in connection with N.D.P.S. Case No. 120 of 2012.
