The petitioner apprehends his arrest in Sanokhar (Amdanda) P.S. case No. 126 of 2015 under Sections 147, 149, 341, 323, 307, 504, 506 of the Indian Penal Code. Later on section 302 of the IPC wad added.
The informant, Devi Ram Pandit, named the petitioner along with other accused persons and alleged that all the accused persons assaulted him and his other family members. Janardan Pandit assaulted his father, Babu Lal Pandit, and his mother, Buga Devi, with Lathi on their head. Babu Lal Pandit got one injury on his head. Another is bruise on his arm. Blood clots were found on both sides of parietal bone of Babu Lal Pandit on account of which he died. There is no allegation against the
Patna High Court Cr.Misc. No.19532 of 2016 (3) dt.18-07-2016 2/2 petitioner that he assaulted Babu Lal Pandit. Similarly situated accused Hina Devi and Mungia Devi have already been granted anticipatory bail by order passed in Cr. Misc. No. 14593 of 2016. It appears that one injury was found on the head of Babu Lal Pandit, the deceased, and the head injury is opined to be cause of death. The injury is said to have caused by Janardan Pandit. Petitioner is not the assailant of Babu Lal Pandit. Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.
10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-4, Bhagalpur in Sanokhar (Amdanda) P.S. Case No. 126 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
