2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 302 and 201/34 of the Indian Penal Code.

3. The case of the prosecution is that the petitioner along with others had gone with the son of the informant. After considerable time, when the son of the informant did not return, the informant made on the mobile of his son which was switched off, after that he received a call from Mobile NO. 8521241246 that his son is with him and they have gone to attend a marriage party. The informant suspects that the petitioner along with other accused persons have killed the son of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that from perusal of the FIR itself, it is clear that two persons are named in the First Information Report (FIR), they are Jitendra Kumar and Praduman Kumar. During the course of investigation, co-accused, namely, Praduman Kumar has given his confessional statement before the police and the name of the petitioner has surfaced on the basis of his confessional statement. Praduman Kumar in his confessional statement has confessed that he himself administered extra dose of intoxicant to the petitioner. There is nothing on record to implicate the petitioner except the confessional statement of co-accused, Praduman Kumar. Further submission is that petitioner is not named in the FIR.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Naubatpur P.S. Case No. 92 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two
