Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504/34 of the Indian Penal Code 3(1) (x) of the S.C./S.T.(Prevention of Atrocities) Act.

The prosecution case is that the accused persons including the petitioners assaulted and abused the informant by calling caste name. When the brother of the informant came to rescue, he was assaulted by the accused persons. It is submitted by the learned counsel for the petitioners that due to petty dispute accusation has been levelled.

Accusation is omnibus and general.

For the occurrence of 02.07.2015 the First Information Report was

Patna High Court Cr.Misc. No.561 of 2016 (2) dt.08-01-2016 registered on 16.07.2015.

Considering the delayed lodging of the case, the aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Bishanpur P.S. Case No. 75 of 2015, pending in the court of learned Additional Chief Judicial Magistrate, Darbhanga.

With this observation this application is disposed of.
