JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-11-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 2565 of 2017, disclosing offences under Sections 498A of IPC and Section 3 of Dowry Prohibition Act.
Allegation against the petitioner, who happens to be the husband of the complainant of demand of one motorcycle and torturing her for non-fulfillment of the same. Submission of the learned counsel for the petitioner is that the whole allegation is false and concocted. The marriage was solemnized in the year 2010 and after seven years, the present case has been lodged. He is still ready to keep her with dignity and care, that stand has also been taken before the
Patna High Court CR. MISC. No.67080 of 2019(3) dt.21-11-2019 2/2 learned court below, but the complainant is not ready to reside with him.
Heard learned A.P.P. also. From the perusal of the impugned order, it appears that the complainant is not ready to reside with the petitioner on the ground of harassment. Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned S.D.J.M. (East), Muzaffarpur, in connection with Complaint Case No. 2565 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
