The petitioner in the present writ application has prayed for the grant of following relief(s):- "(i) For issuance of an appropriate writ in the nature of Mandamus Commanding the Respondent Authorities to consider the case of the petitioner for appointment on the post of Home Guard at Muzaffarpur District pursuant to the Advertisement 2 of 2011.

(ii) For passing the order regarding giving direction to respondent authority to take appropriate action in light of the order passed by this Hon'ble High court vide order dated 05.02.21 in C.W.J.C No.

Patna High Court CWJC No.13656 of 2025 dt.26-09-2025 2/3 11645/2019 (Annexure P/3 of writ application) (iii) For passing the order regarding giving direction to respondent authority to take appropriate action to prepared fresh list as district wise and filled up total vacant post. (iv) Any other Order or orders as your lordship may deem fit and proper in the facts and circumstances of the case be granted to the Petitioner."

3. For claiming the same relief the petitioner had earlier also filed a writ application bearing CWJC No. 4482 of 2025 in which final order was passed on 25.03.2025 (AnnexureP/8). From perusal of the said order dated 25.03.2025 passed in CWJC No. 4482 of 2025 it transpires that the said writ application was dismissed as withdrawn granting liberty to the petitioner to move further, if so advised. In terms of the liberty so granted by this Court on an earlier occasion, the petitioner filed a representation dated 29.03.2025 before the District Magistrate, Muzaffarpur, which is still pending consideration.

4. In light of the aforesaid facts, it is clear that in terms of the liberty granted by this Court earlier vide order dated 25.03.2025 passed in CWJC No. 4482 of 2025, the petitioner is in the process of availing the same by filing a representation which is still pending.

5. Since the representation is pending before the

Patna High Court CWJC No.13656 of 2025 dt.26-09-2025 3/3 District Magistrate, Muzaffarpur, therefore, the present writ application is disposed of directing the District Magistrate, Muzaffarpur to finally decide the representation of the petitioner within four months from today after giving an opportunity of hearing to the petitioner, by passing a reasoned and speaking order.

6. With the aforesaid observation and direction, the present writ application is disposed of.
