Mr. Prashant Pratap, GP 6 ====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL JUDGMENT Date : 19-12-2018 Heard learned counsel for the petitioner as well as learned counsel appearing for the opposite parties.

2. The opposite party No. 4 has filed show cause disclosing this fact that at present the Co-operative Societies is not functional nor any Administrator has been appointed. The opposite party No. 4 has also averred in show cause that he has already written to Joint Registrar, Co-operative Societies for constitution of Ad hoc Committee in accordance with rules and, similarly, he has also written letter to the District Magistrate, Katihar, for vesting power to file and to deal with the

Patna High Court MJC No.1766 of 2016 dt.19-12-2018 2/2 certificate cases.

3. Moreover, in course of hearing, learned counsel appearing for the petitioner fairly concedes this fact that the certificate cases have already been filed but the aforesaid certificate cases are not being disposed of by the concerned authorities.

4. In view of the aforesaid facts and circumstances, in my view, it is needless to keep this matter pending because the order dated 18.11.2014 passed in C.W.J.C. No. 13743 of 2008 appears to have already been complied with and, accordingly, this petition stands disposed of.
