This application for anticipatory bail arises out of Barun P.S. Case No. 174 of 2018 for the offence punishable under Sections 406, 409 and 420/34 of the Indian Penal Code. Learned counsel appearing on behalf of the Bihar State Food and Civil Supplies Corporation states that he does not have any instructions to oppose the prayer for anticipatory bail since the criminal case has been lodged by the Block Co-operative Extension Officer, Barun, in relation to misappropriation of food grains to the tune of Rs.30,08,966.39

Learned counsel appearing on behalf of the petitioner, with reference to a supplementary affidavit, which has been filed, has submitted that the entire amount, alleged to have been defalcated, has been deposited in the concerned account maintained at Aurangabad District Central Co-operative Bank Limited at Barun after lodging of the First Information Report.

Considering the above submission made on behalf of the petitioner and learned counsel for the BSFC, this application is allowed.

Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Aurangabad, in Barun P.S. Case No. 174 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail
