JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-01-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,148,323,341,379 and 504 of the Indian Penal Code and section 3(1) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.
It is alleged that the petitioners came variously armed, dismantled the hutment of the informant and snatched gold chain worth rupees twenty thousand and petitioner no. 6 took wrist
Patna High Court Cr.Misc. No.203 of 2016 (2) dt.06-01-2016 2/2 watch worth rupees three thousand.
It is submitted by the learned counsel for the petitioners that the accusation is omnibus and general and for the occurrence of 24.5.2015 the FIR was registered on 13.7.2015. Admittedly the place of occurrence is the house of the informant which cannot be treated to be a place of public view. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the delayed lodging of the case and the accusation being omnibus and general, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Araria in connection with Araria SC/ST P.S. Case No.39 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
