JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 06-12-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 147, 341, 323, 307, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.
It is alleged against the petitioner that in the background of some dispute, the petitioner and coaccused Gaurav Kumar fired upon the informant.
Patna High Court CR. MISC. No.60902 of 2023(3) dt.06-12-2023 2/3 It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. From bare perusal of the F.I.R, it appears that co-accused Gaurav Kumar shot fire over the back of the informant and this petitioner fired upon the informant which hit over the hand of the informant which is non-vital part of the body. The injury report of the informant also does not corroborate the case as against the petitioner. The petitioner is languishing in custody since 08.05.2023.
In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.
Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Begusarai in connection with Muffasil P.S. Case
