JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-01-2015 Petitioner is languishing in custody since 01.02.2014 in a case registered for the offences punishable under Sections 20/22 of the N.D.P.S. Act.
From the possession of the petitioner twelve kg ganja were recovered.
It is submitted by learned counsel for the petitioner that seizure list does not bear the signature of the petitioner. This fact has not been controverted by learned A.P.P. after going through the case diary.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail
Patna High Court Cr.Misc. No.25529 of 2014 (6) dt.09-01-2015 2/2 bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Bhojpur, Ara in connection with Ara Nawada P.S. Case No. 58 of 2014, N.D.P.S. Case No. 01 of 2014.
Let learned Court below cancel the bail bonds of the petitioner, if the petitioner defaults for three consecutive occasions during the trial.
