The petitioner is apprehending arrest in a case registered for the offences punishable under sections 153 and 174(i) of the Railway Property (Unlawful Possession) Act. 125 meters of catenary wire of the railway was stolen leading to registration of the FIR against unknown. During investigation, it was found that the petitioner along with his associates were found moving in suspicious condition on the alleged date of occurrence.

It is submitted by the learned counsel for the petitioner that only on suspicion the petitioner has been roped in the present case only because he is accused in one other case of

Patna High Court Cr.Misc. No.20541 of 2016 (2) dt.13-05-2016 2/2 similar nature.

Considering the suspicious nature of accusation, it is a case for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with RPF/Post Barsoi Case No. 54 of 2014 pending in the court of learned Railway Judicial Magistrate, Katihar.

This application is disposed of with the aforesaid observation/direction.
