The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 7 of the E.C. Act.

As per prosecution case, petitioner by using substandard measurement machine and provided 3-5 kg. less quantity of grains to the PDS beneficiaries. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that as a matter of fact that one Ramanand Sagar has voluntarily sworn an affidavit before Siristedar of Civil Court, Bhabua, who admitted that PDS shop keeper Lallan Ram of village-Fulli has committed no irregularity. Patna High Court CR. MISC. No.70388 of 2021(2) dt.25-07-2022 2/2 of S.V.P. College, Bhabua, where some his known persons came and narrated what were written by him without his personal knowledge or information and what so was not used by him, as such, he was made confused by villagers, who got undue advantage in Panchayat Election.

Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Bhabua (Kaimur) in connection with Kudra P.S. Case No. 259 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
