The petitioner seeks bail in a case registered for the offence under Section 272, 273 of the I.P.C. and Section 30(a) of Bihar Prohibition and Excise Act.

Total 523 liters & 800 ml. of illicit foreign liquor has been recovered from the houses of two co-accused persons and name of petitioner has come during course of investigation. It is submitted on behalf of petitioner that nothing has been recovered either from the conscious possession or from the house of this petitioner and he is in custody since 26.09.2021. Learned A.P.P. for the State has opposed the bail petition and submitted that petitioner has got criminal antecedent and he is accused in one more case of Excise Act. Considering the aforesaid facts & circumstances and

No.70542 of 2021(2) dt.22-12-2021 2/2 the fact that petitioner has got criminal antecedent of similar nature of case, the learned court below, where the case is pending, is directed to release the petitioner on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Raghunathpur P.S. Case No. 142 of 2019, after framing of the charge.
