2. Petitioner seeks regular bail in a case registered for the offence punishable under Sections 30(a) of the Bihar Prohibition & Excise Act .

3 . As per the prosecution case , 150.840 litres of English liquor was recovered from motorcycle in question which was parked near poultry farm.

4. Learned counsel for the petitioner submits that petitioner is neither owner nor the driver of motorcycle in question . No incriminating material has been recovered from conscious possession of the petitioner and he has been made accused only on suspicion . Petitioner is in custody since 25.07.2024 .

6. Considering the nature of accusation and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Special Judge Excise Samastipur in connection with Vaini P. S. Case No. 04 of 2024 .
