The petitioner has preferred this application for grant of regular bail in a case registered under section 414 of the Indian Penal Code, sections 25(1-B)(a), 26 and 35 of the Arms Act and sections 8 and 20(b)(ii)(C) of the N.D.P.S. Act. As per the prosecution case, arms, ammunitions and 980 grams of Charas like substance was recovered from the possession of the co-accused while from the possession of this petitioner, two live cartridges were recovered. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case because of his antecedents. He is in custody since 11.7.2021 and investigation in the case has concluded. No narcotic drugs has been recovered from his possession.

Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner together with the petitioner having remained in custody for more than 10 months, the Court directs the petitioner to be enlarged on bail in connection with N.D.P.S. Case no.61 of 2021 (arising out of Chhatauni P.S. Case no.277 of 2021) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge/Special Judge, Motihari, East Champaran.
