The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 363, 366(A), 34 of the Indian Penal Code.

Prosecution case relates to abduction of minor daughter of the informant, allegedly, aged about 16 years, by the petitioner along with other co-accused persons. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. A statement has been made in para-3 of the petition that the petitioner has got no criminal antecedent. As per the impugned order, the victim girl was recovered and she has not supported the prosecution case in her

Patna High Court CR. MISC. No.58612 of 2022(2) dt.02-02-2023 2/2 statement recorded under section 164 of Cr.P.C. but she was minor at the time of occurrence. It is further submitted that the compromise has been prevailed between the parties and the same has been annexed as Annexure-2. The petitioner is languishing in judicial custody since 16.12.2021. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Riga P.S. Case No. 344 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VI, Sitamarhi.
