3/4 ORAL ORDER 24-08-2018 Heard learned counsel for the petitioners and learned counsel for the State.
In this case, the petitioners applied against the advertisement nos. 50, 51 and 55 of 1998, but they have been appointed in the year 2007. As per Government's new Policy, the petitioners are covered under the Contributory Provident Fund scheme.
Learned counsel for the petitioners submits that as the advertisement was published in the year 1998, it took several years for their appointment, and as such, the petitioners should be governed by the Old Pension Scheme and placed reliance on the order passed by this Court in C.W.J.C. No.10901 of 2006, which has been decided on 03.08.2011 (Annexure-5 to this writ petition).
It appears that the petitioners have filed representation to the competent authority for redressal of their grievance, which is still pending.
In such view of the matter, let the competent authority decide the representation filed by the petitioners in light of the judgement dated 03.08.2011 passed in C.W.J.C. No.10901 of 2006 and take decision in accordance with law.
