JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 16-09-2016 A piquant situation has been created coupled with complete apathy and indifference which has created an unnecessary litigation.
Petitioner was appointed after the recommendation of BPSC in the year 1988 in the cadre of Bihar Agriculture Service Category I. He has rendered service thereafter for a long period of time. May be as a policy decision, the respondent authorities decided to abolish the post of Leave Reserve Officer on which the petitioner was last working. His problem is that because he has not been adjusted against any post or position he is not deriving his salary for a quite a while. Letters have been written in this regard to the Director,
Patna High Court CWJC No.8270 of 2016 dt.16-09-2016 2/2 Agriculture, Government of Bihar, one of them is letter no.603 dated 6.4.2016, annexed as Annexure- 11.
Instead of keeping the matter pending, the Court directs the Director, Agriculture, Government of Bihar to take a decision on the issue within a period of three months from the date of production of a copy of this order. The entitlement of the petitioner with regard to past salary etc. because of the situation created by the respondents will also be kept in mind while taking such a decision. Writ is disposed of in terms of the above.
