JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 16-01-2019 This writ application has been preferred for issuance of a direction to the respondent Bank and it's authorities (respondent Nos. 1 & 2) to disburse the loan amount of Rs. 10 lakhs (in the shape of Term Loan of Rs. 7 lakhs and in the shape of Security Over Draft of Rs. Three lakhs), as per letter of sanction of loan issued vide Reference No. 7407/Credit/ PMEGP/2018/11/01 dated 22.11.2018 (Annexure-1). Learned counsel for the petitioner submits that the petitioner has fulfilled all the terms and conditions of the sanction letter but despite such fulfillment of the conditions, the authorities of the Bank have not disbursed the sanctioned loan. It is submitted that because there is no retained counsel for the Bank in this court, copy of the writ application

Patna High Court CWJC No.1149 of 2019(2) dt.16-01-2019 2/2 has not been served upon.

The Union of India (respondent no. 4) is represented by Mr. Kumar Priya Ranjan, learned Advocate.

In the nature of the pleadings available in the writ application and the relief prayed by the petitioner, instead of issuing notice to the Bank and keeping the matter pending in this court, it is felt just and proper to direct the Regional Manager, Syndicate Bank, Regional Office, Frazer Road, Patna (Respondent No. 1) to consider the grievance of the petitioner, look into the entire matter, examine the materials on the record and take an appropriate decision within a period of 30 days from the date of receipt/production of a copy of this order. If it is found that the petitioner has fulfilled the terms and conditions of the sanction letter and the sanction is in terms of the norms and procedures to be followed by the Bank, respondent no. 1 shall ensure that the petitioner gets disbursement of loan at the earliest.
