Mr.Lalan Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 26-04-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 20/22 of the NDPS Act. As per the prosecution case, total 43 Kg. of Ganja has been recovered behind the house of Santosh Kumar and from the field of Kuldeep Tiwary.

It is submitted that petitioner has been made accused in this case on the basis of disclosure made by co-accused, Jagdish Yadav, who was apprehended on the spot. No narcotic substance has been recovered either from the possession or from the premises of this petitioner. Similarly situated accused Jagdish Yadav has already been granted bail by a co-ordinate Bench of this court vide order dated 01.08.2011 passed in Cr. Misc. No. 23281/2011. Petitioner is in custody since 16.08.2021

Patna High Court CR. MISC. No.71354 of 2021(3) dt.26-04-2022 2/2 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-I, Gopalganj in connection with Barauli PS case No.195/2010.
