Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402, 379, 411 of the Indian Penal Code, Section 27(1-b)a/26/35 of the Arms Act and Sections 20/22 of the Narcotic Drugs and Psychotropic Substances Act, 1985.
Petitioner is in custody since 15.09.2018. Allegation is that a country made loaded pistol along with cartridge was recovered from possession of the petitioner when the police apprehended the petitioner and others on suspicion that they were making preparation to commit dacoity. Petitioner has got no criminal antecedent.
Submission is that other co-accused have already been allowed bail by a Coordinate Bench of this Court vide order
Patna High Court CR. MISC. No.4113 of 2019(3) dt.16-04-2019 2/2 dated 15.01.2019 passed in Cr. Misc. No. 80554 of 2018. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Spl. Case No. 104/2018 arising out of Rupaspur Police Station Case No. 397 of 2018, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
