The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 302/34 of the Indian Penal Code and Sections25(1-b)a/27 of the Arms Act. As per prosecution case, it is alleged that the petitioner and co-accused persons came and co-accused caught hold of the husband of the informant and co-accused Ganaur Yadav and Umesh Yadav shot her husband dead.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner has no concerned with the alleged offence rather he has falsely been implicated in the present case due to village politics. The specific allegation of shot fire upon the husband of

There is general and omnibus allegation is leveled against this petitioner. A statement has been made in para-3 of the petition that the petitioner has got no criminal antecedent. Moreover, Similarly situated co-accused Bipin Yadav has already been granted bail by a co-ordinate Bench of this Court vide order dated 24.8.2022 in Cr. Misc. No. 37225 of 2022 and the same has been annexed as Annexure-2. The Petitioner is languishing in judicial custody since 17.10.2021. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kaluwahi P.S. Case No. 153 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Madhubani.
