The petitioner apprehends his arrest in connection with Bidupur P.S. Case No. 150/13 registered for offences punishable under Sections 341, 323, 324, 307, 379, 504/34 of the Indian Penal Code.
It is contended on behalf of petitioner that there is case and counter case. It is urged that the petitioner's side has lodged first information report prior to the Annexure 1 which is the first information report lodged by the informant of this case. It is further contended that parties are agnates and there is land dispute. Learned counsel further submits that there is allegation upon two accused persons namely, Keshava Kumar Singh and
Patna High Court Cr.Misc. No.58355 of 2015 (2) dt.25-01-2016 2/2 Vijay Kumar Singh, i.e., the petitioner of assaulting by 'Garasa' upon the head of the petitioner but it is apparent from the injury report of the informant that there is only one incised wound which is simple in nature. Thus, it is urged that it cannot be said specifically that the petitioner has caused this injury. It has further submitted that apart from the above there is general and omnibus allegation against the accused persons. Several accused persons have already been granted bail in this matter. Having regard to the facts and circumstances of the case, let the petitioner, namely, Vijay Kumar Singh be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Bidupur P.S. Case No.
150/13, on furnishing bail bond of Rs.10,000( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali, Hajipur subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
