JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-03-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 395 of the Indian Penal Code. Earlier the bail prayer of the petitioner was rejected by a co-ordinate Bench of this court taking note of this fact that looted idol was recovered on the basis of confessional statement of the petitioner.
Learned counsel appearing for the petitioner submits that almost all the co-accused have already been granted privilege of bail by different Benches of this court but I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection with Kateya P.S. Case No. 310 of
Patna High Court CR. MISC. No.3577 of 2019(4) dt.28-03-2019 2/2 2017 stands rejected.
However, the learned trial court should expedite the trial of the petitioner.
