JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 364, 120B/34 of the Indian Penal Code.
Petitioner is named in the first information report but the informant is not an eye witness of the alleged occurrence and in course of investigation some witnesses claimed to have seen the victim in the company of other accused and stated that the victim was taken away by the co-accused at the house of the petitioner and from there the victim went missing. Moreover, one coaccused, Gera Tuddu is said to have confessed his guilt in
Patna High Court Cr.Misc. No.20537 of 2016 (2) dt.19-05-2016 2/2 Panchayati but the aforesaid co-accused has already been granted privilege of bail by a co-ordinate Bench of this Court. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Purnea in connection with Mirganj P.S. Case No. 79 of 2013.
