JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-01-2016 Heard learned counsels for the petitioner and the State. The petitioner being father-in-law of the informant is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379, 504, 498A/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. Prosecution case is that the informant's husband her father-in-law and mother-in-law came abused the informant and made assault. It is alleged that the wife of the petitioner snatched mangal sutra, nose pin and ear-tops of the informant when neighbours came then the accused persons escaped from the scene. It is submitted by learned counsel for the petitioner that accusation is not specific against the petitioner and injury report is not on record.

No.1465 of 2016 (2) dt.12-01-2016 2/2 Considering the nature of accusation, let the above named petitioner be released on provisional anticipatory bail for three months, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, East Champaran, Motihari in connection with Motihari Town P.S. Case No.100/2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.

The provisional bail of the petitioner will be confirmed by the learned court below on verification of the fact that informant has not received any grievous injury, but if it is found that the informant received grievous injury, then the petitioner will surrender and pray for regular bail.
