JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-01-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323,325,504 and 506/34 of the Indian Penal Code and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.
The prosecution case is that the petitioners came and wanted to take away the cow and the calf which was given to the informant. When the informant asked to take the cow after some time then the petitioner made assault.
It is submitted by the learned counsel for the petitioners that the informant wanted to misappropriate the cow entrusted to the informant hence the present case has been lodged. Statement has been made in paragraph 7 of the petition that no injury has

It is further submitted that for the occurrence of 9.10.2015 at 8 P.M. the FIR was registered on 10.10.2015 at 8 A.M. which reached to the court of the learned ACJM on 26.10.2015 which suggests that the FIR was registered by antedating. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the genesis of the occurrence and statement that the petitioners have no criminal antecedent, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs.
10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Bhojpur at Ara in connection with SC/ST (K) P.S. Case No.80 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C. The bail bonds of the petitioners shall be accepted provisionally till the verification of the fact that the informant has not received any grievous injury.
