JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-09-2019 This application, for grant of anticipatory bail, arises out of Maker P.S. Case No. 100 of 2018, disclosing offences under Sections 420, 406, 409/34 of the Indian Penal Code. Prosecution case is that co-accused Baleshwar Singh, the then Secretary Tara Amnour Panchayat, withdrew Rs. 10,90,000/- in April 2017 and Rs. 11,82,500/- in May, 2017 under Saat Nischay Yojna, thereafter, he deposited Rs. 18,71,500/- in the said bank account and thus committed financial irregularity and the name of this petitioner transpired in course of investigation.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and there is no allegation that petitioner withdrew any amount from the account rather the said allegation against the co-accused Beleshwar

Patna High Court CR. MISC. No.57375 of 2019(2) dt.11-09-2019 2/2 Singh, who has been granted the privilege of anticipatory bail by the court below itself.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -XII, Saran at Chapra, in connection with Maker P.S. Case No. 100 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

It is further subject to the condition that petitioner will cooperate in the investigation and appear before the Investigating Officer, as and when required.
