SONI SHRIVASTAVA ORAL ORDER 28-07-2025 Heard learned counsel for the petitioners, learned Additional Public Prosecutor for the State and learned counsel for the opposite party no.3.
2. The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 406, 420, 120B and 34 of the Indian Penal Code.
3. Allegation against the petitioners is that they along with other co-accused persons took money from the informant
Patna High Court CR. MISC. No.68665 of 2023(11) dt.28-07-2025 2/3 for depositing the same in various Co-operative Societies/Companies of Sahara India Group but the same was not delivered to the customers by the directors and officers of the Sahara India Group, even after the completion of the period of maturity.

Learned counsel for the petitioners submits that an amount to the tune of Rs. 5,000/- crores has been released to the Central Registrar of Cooperative Societies from Sahara-SEBI Refund Account where the amount of Rs. 24,979.67 crores were lying unutilized. The said amount of Rs. 5,000/- crores has been directed to be paid to the respective genuine depositors of the Sahara Group of Cooperative Societies. Steps have been taken to refund the amounts to genuine depositors and a notice has also been published on the gazette of India on 20.06.2023 and in this regard a portal has also been created for refunding of the said amount to genuine depositors.
5. Learned counsel for the opposite party no. 3 i.e. Sahara India does not dispute the fact of efforts being taken to make payments to genuine customers.
6. In the facts and circumstances and also taking into consideration the fact that the investors have already applied through portal, let the above named petitioners in the
Patna High Court CR. MISC. No.68665 of 2023(11) dt.28-07-2025 3/3 event of their arrest or surrender before the learned Court below within a period of four weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Samastipur Muffasil P.S. Case No. 526 of 2022, subject to the condition as laid down under Section 438 (2) of the Cr.P.C./482(2) of the B.N.S.S. (Soni Shrivastava, J) devendra/- U T
