1. Heard the parties.

2. The appellant apprehends arrest in connection with Ben P.S. Case No. 68 of 2024 dated 03.06.024 registered for the offence under Section 147, 149, 341, 323, 324, 325, 307, 504, 506 of the IPC and Section 3(1)(r), 3(1)(w)(ii), 3(1)(s), 3(2)(va) of the S.C. & S.T. Act and being aggrieved by the order dated 12.07.2024 passed by learned VIth Additional Sessions Judge -cum-Special Judge SC/ST Act, Biharsharif, Nalanda in A.B.P. No. 1069 of 2024 has preferred this appeal for grant of anticipatory bail.

3. The prosecution case as per the first information report is that on 02.06.2024 while the informant was returning from

Patna High Court CR. APP (SJ) No.4111 of 2024(3) dt.07-02-2025 2/3 village- Lachhanbigha and reached near the house of Chandradip Manjhi, the appellant along with others abused him and when the informant protested, they called him by his caste name.

4. Learned counsel for the appellant submits that as per the first information report the caste name of the informant was not taken by the appellant and others in full public view. He next submits that both the parties are co-villagers and the dispute between them took place while drinking liquor. Similarly situated co-accused Sanjay Singh @ Sanjay Kumar, Bhutali Singh @ Aniket Kumar and Shashikant Kumar have been granted anticipatory bail by this court in Cr. Appeal (SJ) No. 4545 of 2024. The appellant has got no criminal antecedent.

5. Learned counsel for the informant vehemently opposed the prayer for anticipatory bail.

Regard being had to the submission made by the parties, taking into consideration the fact that caste name was not taken in full public view, both the parties are co-villagers, the occurrence took place on trivial issue regarding drinking of liquor, the appellant has got no criminal antecedent and similarly situated co-accused have been granted anticipatory bail, I am inclined to grant anticipatory bail to the appellant.

7. Accordingly, the order dated 12.07.2024 passed in A.B.P. No. 1069 of 2024 by learned VIth Additional Sessions Judge -cum- Special Judge SC/ST Act, Biharsharif, Nalanda is hereby set aside.

8. Let the appellant, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned VIth Additional Sessions Judge -cum- Special Judge SC/ST Act, Biharsharif, Nalanda in connection with Ben P.S. Case No. 68 of 2024 subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
