JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-09-2019 Learned counsel for the petitioners seeks permission to withdraw the present petition on behalf of the petitioner No.2 Manoj Sahani submitting that the aforesaid petitioner has been arrested during the pendency of this case.

Permission is granted.

Accordingly, the present petition arising out of Taraiyan P.S. Case No. 144 of 2019 is hereby dismissed as withdrawn against the petitioner No.2.

Petitioners No. 1, 3 and 4 seek bail in anticipation of their arrest in connection with Taraiyan P.S. Case No. 144 of

Patna High Court CR. MISC. No.57330 of 2019(2) dt.11-09-2019 2/3 2019, registered for the offences punishable under Sections 341, 323, 325, 307, 506, 34 of the Indian Penal Code. As per FIR one Ramkeshwar Sahani was assaulting his Babho on which informant went to save her thereafter the petitioners and other accused persons assaulted him. Pappu Sahni and Ramkeshar Sahni assaulted the informant by means of Tangi. Petitioners are also named in the FIR. Submission of the learned counsel for the petitioners is that there is case and counter case between the parties and no specific allegation of assault has been attributed against any of the petitioners.

Heard learned A.P.P. also.

In view of the above facts and circumstances, let petitioners No. 1, 3 and 4 above named in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of the learned A.C.J.M.9th Saran at Chapra, in connection with Taraiyan P.S. Case No. 144 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immovable
