2. The petitioner has prayed for regular bail in a case registered for an offence punishable under Section 395 of the Indian Penal Code.
3. Allegation against the accused persons including the petitioner is that they assaulted the informant and his friend and also snatched the mobile phone and motorcycle of the informant.
4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. The petitioner is not named in the FIR and his name surfaced in this case only
Patna High Court CR. MISC. No.71708 of 2024(2) dt.31-01-2025 2/3 on the basis of confessional statement of co-accused person. He further submits that petitioner is not put on Test Identification Parade. He next submits that similarly situated co-accused persons namely Pintu Singh @ Spendu Kumar @ Sapendu Singh @ Spendra Singh, Mohan Yadav @ Anuj Yadav, Karan Kumar, Khursheed Ansari @ Manghil, Deepak Kumar @ Deepak Yadav @ Deepak Kumar Yadav and Rohit Kumar Thakur have already been granted regular bail by this Court and a Co-ordinate Benches of this Court passed in Cr. Misc. Nos.7133 of 2024, 14329 of 2024, 28865 of 2024, 38361 of 2024,70574 of 2023 and 79755 of 2023 vide orders dated 20.02.2024, 06.03.2024, 20.05.2024, 22.05.2024, 07.11.2023 and 29.02.2024, respectively. Petitioner is in custody since 21.07.2023.
5. However, learned APP for the State opposes the prayer for regular bail of the petitioner.
6. In view of the aforesaid facts and submissions of learned counsel for the petitioner that similarly situated coaccused persons have been granted bail by this Court and a Benches of this Court, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the
