1. Heard learned counsel for the petitioners and learned A.P.P. for the State along with learned counsel appearing on behalf of the informant.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 117(2), 329(3), 109(1), 74, 351(2), 351(3), 352, 3(5) of the B.N.S.S.
3. Learned counsel for the petitioners after some argument realizing his mistake seeks permission to withdraw the anticipatory bail application with respect to petitioner no.2, namely, Jhagru Thakur @ Umesh Thakur.

5. It is next submitted that petitioner no.1 is a person with clean antecedent and is aged about 75 years. It is next submitted that informant alleges that named accused persons came along with 3-4 unknown accused and started abusing, on objection, Devan gave order to assault, on which Mantun assaulted him by khanti causing injury on head, on alarm, his family members came, when Jhagru and Devan assaulted his brother Hari Shankar Mishra on head and assaulted his nephew Bikram causing fracture of hand and also assaulted his wife.
6. Learned counsel submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that initially the petitioner is alleged to be an order giver but subsequently it is alleged that he along with Jhagru assaulted the brother of the informant and Hari Shankar on head and also assaulted Bikram causing fracture of hand. It is submitted that no doubt one of the injuries suffered by Bikram on nose is opined to be grievous but then it is submitted that a person who has remained a person with clean antecedent all through out 75 years of age, it does not appear probable that the petitioner at this age would have indulged in such an occurrence. It is also submitted that since the petitioner is karta of his family as such he has been implicated in order to coerce

7. Learned A.P.P. and the learned counsel appearing on behalf of the informant opposes the prayer for anticipatory bail of the petitioner.
8. Considering the submissions made by the learned counsel for the petitioner and also taking into consideration the age of the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned trial court where the case is pending/successor court in connection with Ballia (Baliya) P.S. Case No.110/2025, subject to the conditions as laid down under Section 482(2) of the B.N.S.S.
