JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 12-01-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Mairwa P.S. Case No.30 of 2015 registered under sections 147, 148, 149, 341, 323, 379, 427 and 506 of the Indian Penal Code as well as section 27 of the Arms Act.

It is contended that the petitioner has got no criminal antecedent and similarly circumstanced co-accused Chhotu Rai @ Abhilash Rai has already been granted anticipatory bail by a coordinate Bench of this Court vide order dated 07.10.2015 passed in Cr. Misc. No.40264 of 2015 as contained in annexure-2 to the present application.

Learned counsel for the State does not dispute the

Patna High Court Cr.Misc. No.671 of 2016 (2) dt.12-01-2016 2/2 factum of grant of anticipatory bail to co-accused Chhotu Rai @ Abhilash Rai.

Regard being had to the reasons assigned in the aforesaid order dated 07.10.2015, in the event of arrest or surrender in the court below within six weeks from today, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Mairwa P.S. Case No. 30 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J) Md.S./- U T
